Notice: This is an informational English translation. The legally binding version of these Terms is the Portuguese (Brazil) version. In the event of any discrepancy, the Portuguese version prevails.

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern access to and use of the website of GRON 3D STUDIO (“GRON 3D”, “we”, “our”) and the engagement of the architectural visualization services we offer. By accessing this website, requesting a quote, or engaging any service, the client (“Client”, “you”) declares that they have read, understood, and fully accepted the conditions described herein.

GRON 3D is a private legal entity, registered under the corporate name ESTÚDIO GRON 3D RENDER LTDA, enrolled with the Brazilian taxpayer registry (CNPJ) under no. 48.224.947/0001-02, headquartered at Avenida Doutor Laerte Vieira Gonçalves, 1737, Loja 01, Santa Mônica, postal code 38408-176, Uberlândia/MG, Brazil.

If the Client does not agree with any provision of these Terms, they must refrain from engaging the services.

2. Description of Services

GRON 3D provides B2B architectural visualization and digital modeling services, including but not limited to:

  • Renders (high-quality still images);
  • Three-dimensional electronic models;
  • Illustrated/furnished floor plans;
  • Animations and virtual tours;
  • BIM modeling and related services.

The specific scope, deadlines, number of images, delivery formats, and values of each project will be defined in a commercial proposal and/or specific contract entered into between the parties, which integrate and supplement these Terms. In the event of conflict between these Terms and a signed specific contract, the specific contract prevails.

2.1. Business Nature of the Services

GRON 3D’s services are intended for professional and business clients (B2B), such as construction companies, real estate developers, architecture and design firms, manufacturers, and professionals in the construction and real estate sector, who engage the services within the scope of their economic activity. The services are not offered as consumer products intended for an end consumer and, as a rule, do not constitute a consumer relationship.

3. Intellectual Property and Copyright

3.1. Delivery to the Client

Upon full payment of the agreed amounts, GRON 3D grants the Client a license to use the final deliverables of the project, in the contracted formats (for example, high-resolution image files — JPG, PNG, TIFF — or video files). This license authorizes the Client to use the final deliverables for the commercial and promotional purposes of their own projects.

3.2. Retention of Native Files

The native and production files remain, in all cases, the exclusive property of GRON 3D. This category includes, without limitation:

  • 3D modeling files (scenes, geometries, meshes);
  • Textures, materials, and maps;
  • Scene files from rendering and compositing software;
  • Lighting, camera, and render configuration setups;
  • Any intermediate working files (“open files”).

GRON 3D does not deliver native files as part of the standard service. The assignment or licensing of these files constitutes a separate matter, subject to specific negotiation and remuneration, formalized in a separate contract.

3.3. Assignment of Economic Rights

The transfer of any economic copyright over the works produced, beyond the license of use described in clause 3.1, will only occur upon express written provision, with the corresponding consideration. The absence of an express assignment clause implies the full retention of rights by GRON 3D, under Brazilian Law No. 9,610/1998 (Copyright Law).

4. Portfolio Use and Promotion

The Client acknowledges and authorizes GRON 3D to use the images, animations, and other materials produced within the project for the purpose of promoting its own work, including, without limitation:

  • Physical and digital portfolio;
  • GRON 3D’s institutional website;
  • Social media (Instagram, LinkedIn, YouTube, among others);
  • Commercial presentation materials, industry competitions, and awards.

4.1. Confidentiality Exception

The authorization in clause 4 does not apply where there is a Non-Disclosure Agreement (NDA) or confidentiality clause expressly entered into between the parties, a common scenario in pre-launch or embargoed projects. In such cases, GRON 3D will only disclose the material after written authorization from the Client or after the agreed confidentiality period has ended.

4.2. Client Objection

Should the Client not wish their project to be disclosed, they must express such objection in writing by the time of final project delivery. GRON 3D will honor such request, without prejudice to the performance of the contracted services.

5. Approval Cycle, Revisions, and Changes

5.1. Previews and Approval

The workflow provides for the delivery of previews (reduced-resolution or watermarked versions) for Client validation at predefined stages. Approval of each stage is a condition for proceeding to the next phase.

5.2. Revision Limit

Each project includes a defined number of revision rounds, as specified in the commercial proposal. Revisions within the approved scope and relating to finishing adjustments (color, materials, framing, lighting) are included in the contracted value, subject to the established limit.

5.3. Scope Changes and Additional Charges

The following will be considered scope changes, subject to additional quotation and charges:

  • Modifications to the architectural project after production has begun (changes to layout, massing, façade, furnishings, or any structural element of the project);
  • Revision requests exceeding the contracted number of rounds;
  • Rework arising from incorrect, incomplete, or altered information provided by the Client;
  • Inclusion of new scenes, angles, or deliverables not originally foreseen.

In such cases, GRON 3D will present a supplementary quote, the written approval of which is a condition for carrying out the changes, and which may entail a revision of delivery deadlines.

6. Deadlines, Payment, and Delays

Delivery deadlines run from the receipt of all necessary materials (project, references, complete brief) and confirmation of the initial payment, where applicable.

Payment conditions (amounts, installments, advance payment) will be defined in the commercial proposal. Delivery of the final high-resolution versions is conditional upon full payment of the project.

Delays in the delivery of materials or in the approval of stages by the Client automatically extend the delivery deadlines, at no cost to GRON 3D.

7. Responsibilities and Limitation

GRON 3D undertakes to apply its best technical efforts to the fidelity of the visualization to the project provided. However, the Client acknowledges that:

  • The images are artistic and interpretive representations and may present variations relative to the constructed work (especially in colors, textures, and lighting conditions, which depend on physical and manufacturing factors);
  • GRON 3D is not responsible for discrepancies arising from errors, omissions, or changes in the materials and projects provided by the Client;
  • GRON 3D’s liability, except in cases not subject to limitation by law, is limited to the amount actually paid by the Client for the corresponding project.

8. International Service and Languages

GRON 3D serves clients in Brazil and abroad. This website and these Terms may be made available in Portuguese, English, Spanish, and Italian for the Client’s convenience.

In the event of any discrepancy in interpretation between the translated versions, the Portuguese (Brazil) version shall prevail, constituting the official and legally binding version of these Terms.

9. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the Federative Republic of Brazil.

The courts of the District (Comarca) of Uberlândia, State of Minas Gerais, Brazil are elected, with express waiver of any other, however privileged, to resolve any disputes arising from these Terms or the provision of services, except in cases of mandatory legal jurisdiction in favor of the consumer, where applicable.

10. General Provisions

The eventual nullity or unenforceability of any clause of these Terms will not affect the validity of the others. Tolerance regarding the breach of any obligation will not imply novation or waiver of rights.

GRON 3D reserves the right to amend these Terms at any time by publishing the updated version on this website, indicating the revision date.
